1. General

1.1 These terms and conditions ("Terms") govern the use of the H2O SXM B.V. ("us", "we", or "our") website ("the Website") and all related services provided by H2O SXM B.V. This includes seatoy rentals, watersports lessons, and watersport activities ("Services"). Please read these Terms carefully before using our Website or our Services.

1.2 By accessing and using the Website and our Services, you acknowledge and agree to these Terms. If you do not agree with these Terms, please do not use our Website or our Services.

2. Services

2.1 Our Services are available for online booking and payment through the Website. All Services are subject to availability and we reserve the right to refuse or cancel any booking.

2.2 Services may be subject to specific terms and conditions, which will be made available to you at the time of booking. Your use of such Services will be subject to those additional terms and conditions, in addition to these Terms.

3. Bookings and Payments

3.1 All bookings are subject to acceptance by us, and a contract will only be formed when we have confirmed your booking and received full payment from you.

3.2 Payments are processed through our secure online payment system. Your payment information will be handled securely and will not be shared with third parties, except as necessary to process your payment.

4. Cancellation Policy

4.1 If you cancel your booking more than 8 days prior to the scheduled service, we will refund your deposit. If you cancel 8 days or less prior to the service, your deposit will not be refunded. If you cancel 4 days or less prior to the service, the full balance is due.

4.2 If you are unable to attend your booked service due to a confirmed COVID-19 infection, no cancellation charges will apply upon presentation of valid proof of infection.

5. Sea Condition Policy

5.1 Our instructors reserve the right to cancel any watersport activity or rental due to adverse weather or sea conditions. If your service is cancelled due to such conditions, you will have the option to reschedule or to have your deposit refunded.

6. Liability and Insurance

6.1 Our liability for loss or damage is limited to foreseeable loss or damage which is a direct result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable.

6.2 Your booking will not be activated until you have duly signed the Waiver, which will be sent to you by email after your payment has been received. The Waiver may be signed electronically or in person at the time of the service.

6.3 It is your responsibility to have sufficient insurance coverage for any damage, injury, or loss that may occur during the use of our Services. We will not be responsible for any such damage, injury, or loss.

7. Changes to These Terms

7.1 We reserve the right to change these Terms at any time. Any changes will be effective from the date they are posted on the Website. Your continued use of the Website or our Services after changes are posted constitutes your acceptance of the updated Terms.

8. Governing Law

8.1 These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of the Royal Kingdom of the Netherlands.
